Agreed between Henry Stewart, St Fort & George Just builder Neweport: - Agreements of 9 & 14 Feb 1852 - George Just wanted to purchase in feu all & whole Woodmuir Park (12 acres or thereby) as on plan by William Scott architect Dundee, and George Just not being then in a condition to ask an absolute and unconditional sale in feu form, the parties agree as follows:- George Just to purchase in feu form at a yearly feu duty lots 1 & 2 and to build a dwelling house on each lot, to form the streetsto the extent of their boundaries of the said lots, make all drains & sewers, & George Just to occupy as tenant the remaining portion of the park from Martinmas 1851 at a yearly rent & to be entitled to build and go on building houses on the remaining portion, make up streets & build drains & sewers ... Upon George Just commencing to build on any of the said lots, the lots so commenced should be feued to himat a feu duty ... In order to secure a supply of water for the houses already built & for those to be built, George Just opened 2 wells in the said park, i.e. one at the SW corner thereof and in or near the NW boundary on that part delineated as lot 37, & the other at the SE corner and in or near the SE boundary of lot 31, and pipes were laid from the said wells through the park ... the water was found to be inadequate - requested drawing water from other parts of St Fort estate, therefore the following works have been constructed or are in the course of being completed (1) a reservoir has been constructed in the N extremity of the park or wood to the east of Mutton Hole, part of St Fort estate, about 15' x 10' and 7' to 8' deep, and now or about to be surrounded by a paling or fence; (2) collecting drains or trenches by way of feeders to said reservoir have been made as follows - (a) a drain about 2' deep and 1.5' wide laid with 1.5" tile beginning at or near the well called 'Medicine Well' in the NE corner of the West Hill park on the farm of Friarton, from there running westward through that park & through the foresaid park or wood till it joins the reservoir, (b) and also another similar drain commencing in said park or wood about 25 yd SE from the reservoir, running NW to the first drain, joining it about 6 yd from the reservoir; (3) a pipe of 0.5" bore laid about 18" deep from the reservoir to the said park called Woodmoor Park, leading NW from the reservoir to & over the boundary of the park or wood, and then down the eastern boundary of the park on the farm of Woodhaven (part of St Fort) which immediately adjoins Tayfield estate till you come to the turnpike road leading from Newport to Woodhaven and then E through the road and into the park ... by which pipe water is carried to the houses but also is carried tothe 2 wells mentioned as fountains or reservoirs for supplying a continued supply of water to the houses ... wells constructed by George Just - expense could be charged to each feuar ... power of St Fort to fill up the reservoir & make good ... only waste water from the cistern close to the Medicine Well is to be used, power to construct troughs for animals on St Fort parks (with ball cocks), other parties may take water from the reservoir ...
