Extract from full sasine:
Cupar 16 June 1841 … On 29 May 1841 appeared Alexander Kermath, lately baker Dundee now residing at Waterside & for Mrs Isabella Mackie or Kermath his spouse, & Robert Rintoul, merchant, residing Newport as bailie … holding a feu disp by David Just, mason at Waterside, consent David McEwan, writer Dundee, to Adam Symon, machine maker in Dundee, all & whole these subjects, being no. 3 in that disp, and a disp by Adam Symon to Isabella Kermath
(1) all & whole the piece of ground with the growing timber thereon, pt of Broadhaugh Croft, part of the subjects in disp 1 February 1817 by deceased Thomas Just to his son William & charter of resig 3 August 1821 by William Berry to William Just & recorded 25 September 1821, bounded by property belonging to Robert Just & secondly hereinafter described on the S; by property belonging to David Just & which runs in a straight line N from the W boundary of the property belonging to him, part of said field called Broadhaugh on E; by high water mark on N; & by property of William Just running in a straight line N from the E wall of William Just's property on the W; with dwelling house etc erected by Adam Symon upon the piece of ground before described, together with the right to a road leading from the King's highway to the sea & right of shipping via that road … which subjects first disponed were acquired from William Just mason formerly residing at Scotscraig Cottown afterwards at Newport by David McEwan, writer Dundee, by whom were disponed to Adam Symon 21 May 1828 …
(2) all & whole that piece of ground about 1 rood Scots (1 rood 10 poles 13 yds imperial) bounded on S by King's high road; on E by that stripe of ground pt of the subjects which were disp by Thomas Just feuar at Justfield to David Just his son, & which portion belonged to Adam Symon & has been converted by him into a road for his own exclusive use & is also hereinafter described; on N by subjects first here described which were formerly separated from the subjects (2) by a stone dyke which was the property of Adam Symon; & on W by a straight line running S from the said N boundary to the foresaid highway, the division of which line is pointed out by 2 march stones, 1 at N, 1 at S of said line, 90' 6'' in breadth;
(2a) as also that small narrow piece of ground adjoining (2) and stretching along from NW corner thereof, bounded on S by a straight line running W from the first march stone until it reaches the dyke forming the W boundary of the property of William Just, son of Thomas Just, proceeding over a third march stone fixed about 4' from the said dyke; on E by subjects (2); on N by subjects (1) from which they were separated by a stone dyke; and on W by said dyke forming the boundary of William Just's property, which 2 pieces of ground making up (2) are parts of all & whole the W part of a small park of land, pt of Broadhaugh bounded by high road on S, by a stone dyke on N, by William Just's lands on W, & by E half of said park disp by Thomas Just 1 February 1817 to David Just his son on E, … duty to leave a path of 4' leading downwards to the river from the remaining parts of the subjects second disp in that disp & still belonging to Barbara Mackie / Just relict of Thomas Just & said Robert Just, beginning at the most W portion of the piece of ground last mentioned thence along the W side of the property first described giving access to the river from the lands second disp by Thomas Just to Barbara Mackie & Robert Just to Adam Symon by feu disp 20 January 1836;
(3) all & whole the piece of ground 12' broad all the length S to N being the W-most part of all & whole the E half of a small park of land part of the croft of Broadhaugh disp by deceased Thomas Just to David Just, mason Waterside, his son 1 February 1817, bounded by high road on S, by stone dyke on N, by W half of Broadhaugh disp by Thomas Just to Robert Just brother uterine of said David Just on W, & remaining part of said park still belonging to David Just on E,
(3a) & also 12' clear breadth of ground leading straight N from N boundary of said piece of ground last mentioned to the River Tay being part of Broadhaugh disp by deceased Thomas Just to William Just and afterwards acquired by David Just which subjects 3rd disp to Adam Symon by David Just 31 May 1828 … & whole buildings etc … Alexander Kermath to have no right in rents while his wife is alive … RS 32/245/25
