| Cupar 30 Nov 1867 … James Brown … £550 instantly paid by David Cooper sometime slater Dundee now residing Newport … disp to David Cooper pce grnd & dw ho etc t/on … pt of subjects by Mathewson 25 Jan 1867 … : E by subjects still belonging to John Mathewson & separated by a mutual stone dyke, : S by subjects still belonging to me [James Brown] separated by a mutual stone dyke, : W partly by a road or passage leading to the subjects from Manse Road & partly by subjects disp to Peter Scott mason Newport separated by mutual stone dykes, access to grnd between this house & Peter Scott's for repairs to west gable, : N by a road from Manse Road eastwards … £3-12-6 feu duty … not competent for [D Cooper] to erect any building greater in height that the dwelling house already on the ground nor to erect any house or offices greater than 8' in height … [D Cooper] has free access to these subjects from the Manse Road along a road lying immediately S of the property belonging to Mrs Ann Forrest / Gibson and a passage at least 4' wide in a continuation thereof which [Fowler / Brown / Forrester] and [P Scott] are bound to leave out to the S of their dwelling houses ... liberty to take water from well on subjects still belonging to me [James Brown] lying to the S of these subjects but only by means of a pipe laid between the well & these subjects as at present … use of a drain running through the ground still belonging to me [James Brown] for taking away their soil water as at present … RS 32/361/32 |
