Feu disposition by James Brown to John Scott & spouse. 17 May 1887. James Brown builder in Newport proprietor of the lands dispones to John Scott glazier Dundee and his spouse Mrs Janet Helen Jeffrey or Scott in fee & liferent for £800 and the feu duty, all & whole the piece of ground in Kilnburn Place, Newport, parish of Forgan, County of Fife with the dwelling house and pertinents erected thereon including all gates, gas fittings & other fittings & blinds, the house being the 19th dwelling counting southward from the Congregational Church in Newport, the land bounded as follows: on the north by subjects disponed by James Brown to the said John Scott and now belonging to Mrs Dickson, on the south by subjects disponed by James Brown to James Lawson clothier Dundee, on the east by Kilnburn Place, on the west by subjects belonging to the heirs of the late John Berry of Tayfield ... free ish and entry by the roads and streets front and back ... the ground is part of the piece of ground 1.993 acres conveyed by John Berry to James Brown registered in the sasines of Fife 12 May 1874 ... the gable walls with the adjoining properties north and south shall be mutual ... subject to the burdens and declarations of the feu contract previously mentioned, particularly that John Scott shall be at the expense of keeping Kilnburn Place in proper order and condition opposite his property but only to half the width, and to maintain the footpath, stone kerb and water channel on the west side of the street, as also the portion of the path or passage of 10' in width shown on the plan in so far as it is on and over the piece of ground hereby disponed, which path or passage in its whole extent from Kilnburn Lane on the north to its termination on the south shall in all time coming be common to the said disponees. Kilnburn Lane - [further to the conditions in the 1874 feu (1874.03235)] - James Brown and the other feuars of the Kilnburn Field were of the opinion that instead of making it as originally proposed it would be better to make such a road or access to the houses as marked on the plan 2, and James Brown & the other feuars entered into agreement with Tutors of William Berry dated 2 Sep 1878 whereby James Brown etc can make an entrance to Kilnburn Field at the place and in the manner shown, thereby renouncing their rights to the ground which was originally intended for Kilburn Lane and generally all right they had to the north of Kilnburn Place except the entrance marked 2, and that that should be the only entrance to Kilnburn Field at the north. The house, parapet walls and iron railings to be maintained, no alterations to the exterior of the house without permission from James Brown but they can paint & repair them as necessary. James Brown has constructed a large common drain down to the River Tay and John Scott shall have full use of said drain, James Brown will not connect more branch drains to it than its capacity will manage. Entry at Whitsunday (15 May) 1887, feu duty £6-6-0 annually, with a payment of a further £6-6-0 at the expiry of every 25 years.
