Cupar 6 Oct 1860. Rev Thomas Just proprietor dispones to Janet Duncan / Petrie Newport, wife of James Petrie engineer, presently in Russia, & James Petrie ... piece of ground lot 2 on plan of Wellgate Park, Newport, belonging to me, lying on S side of turnpike road Newport - Woodhaven, 48 poles imperial bounded on S by a 24' road, on N partly by a piece of ground presently used as a bleaching green, partly by a piece of ground occupied as a garden & partly by a vacant piece of ground, on E by a 20' street, on W by lot 3 ... right to lay a drain from the ground through the westend of the garden ground on the northside thereof to the sewer on the N side of the turnpike road, ... with power to them to open a well upon the subjects for their own use with the right to use any well sunk by me for the use of the feuars of the Wellgate Park ... including half the street on E & S ... right of use of the present road running S from the turnpike road on the W side of the old houses fronting the turnpike road belonging to me ... until the roads are all properly made up (that not until lots on both sides of them have been sold) ... no rubbish or obstruction to be left on the roads - 5/- fine to be paid to the poor of Forgan parish - use for dwelling house only - house to be built within 18 months, of stone & slate, not more than 26' height from road level on S to ridge of roof ... they shall build a stone parapet wall with droved coping not more than 3' height with an iron railing on S side next to the street on the S, & a stone parapet wall with coping not more than 1' height & railing on N boundary. In the event of me or my successors acquiring the full right to the bleaching green & ground on N side of said subjects I will make first offer to them at the current rate of feu duty before disponing to any other person ... prohibitted to make dung stances, slaughter house & shambles, spinning mills, iron foundry or engine manufactory & carrying on any soapwork, candlework or any other work equally or more offensive & from opening a quarry & selling stones ... entry Whitsunday 1860.
