5 Feb 1863. Feu contract - William Moon, merchant Dundee & Charles Smith, formerly builder Dundee, directors ... & Duncan Sidey ... Craighead near Newport, general manager of the Eastern Bank of Scotland ... & Miss Elizabeth Tod Mudie residing in Newport in consideration of the feu duty ... all & whole that pce grnd lot 30 on feuing plan by William Scott architect Dundee of part of the lands of Craighead laid out as building plots ... 46 pol 15 yd (half of street aftermentioned being included in said measurement) bounded as follows - on N by street 25' wide, on E by lot 29 at present unfeued, on W by lot 31 feued to George Whitton brewer Dundee, on S by property belonging to John Berry Esqof Tayfield ... & whereas in original feu disp of said lands of Craighead granted by Robert dalgleish of Scotscraig to James Wilson corn merchant in Cupar (7 Mar 1828) are, inter alia, the following provisions ... power & liberty ... to use the water of the spring in the said Robert Dalgleish's park to the south of the ground feued by the said disp & at their expense to conduct & convey the same for their use into the subjects above described, as also to quarry & carry away at their expense from the quarries then opened or that might be opened by Robert Dalgleish ... in said park such stones as might be useful for building & inclosing the lands feued ... power to Elizabeth Tod Mudie to use said water & said quarry ... to build stone & lime walls not more than 6' high to lie between this lot & lot next to east, ... half cost borne by eventual feuars of lot 29 ... half cost of wall between lot 31 & this lot ... not to use grounds as public cemetery, a public dung stance, or for a spinning mill, iron foundry or engine manufactory or any such purpose injurious to the amenity of the neighbourhood ... (also applies to other feuars of other parts of ground to south of turnpike) ... roads only to be opened up as far as feued lots are let unless first party think otherwise ... power of first party to alter lines of roads, sizes of unlet plots ... Elizabeth Tod Mudie to build at least one good & substantial stone & slated house upon the lot of value of £250 at least within 2 years from term of entry & thereafter to keep & maintain & uphold a house of that value upon said lot for all time coming ... plans to be submitted to superiors prior to building ... site of the house shall be upon the centre of the lot ... Miss Elizabeth Tod Mudie shall make form or complete at her own expense the street ... opposite the lot disponed ... (half cost to be borne by purchaser of feu to north) ... Elizabeth Tod Mudie shall complete a footpath on south side of said street ... footpath not less that 4' wide ... main drain or sewer in street on west boundary of said lands & convenience & use of feuars of lots 26, 27, 28, 29, 31, 32 & 30 a drain shall be constructed on said road ... costs to be borne propoirtionally ... Entry at Martinmas 1862. First party is superior. Feu duty £3-9-8 annually, doubling on each successive entry of heir & successor. Signed at Newport 30 Oct 1862.
