Feu disposition by John Berry to James Brown. 12 May 1874. John Berry Esquire of Tayfield heritable proprietor in consideration of the feu duty and other prestations hereby dispones in favour of James Brown builder in Newport ... all & whole that piece of ground being part of that field called the Kilnburn Field lying immediatelyto the east of the Tayfield Mansion House Park or Policies, which piece of ground is delineated on a plan ... extends to 1.993 acres or thereby, bounded as follows: on the north partly by ground belonging to John Berry and partly by the piece of ground feued to the Rev John Tait, Minister of the Congregational Church, Newport and others as trustees for the said church, on the west by a wall or dyke partly already built and which will be completed by James Brown within 2 years from Whitsunday 1874 and when completed shall form the boundary between the ground hereby disponed and the Mansion House Park or Policies of Tayfield; on the south by the turnpike road leading from Newport to Cupar; on the east by a proposed street called Kilnburn Row but which is now to be called Kilnburn Place, which street was originally proposed to be 30' but is now arranged to be 40' in width one half of which is included in the measurement of this plot ... John Brown shall be bound within 2 years after the term of his entry to erect and thereafter maintain on the piece of ground buildings of the value of at least £6000 failing which double feu duty shall be paid ... buildings to be covered with blue slates and the frontage shall in all time coming be in conformity with the line of frontage shown on the plan; also James Brown shall (with the exception of the outlet to Kilnburn Lane at which spot a gate or doorway may, with John Berry's approval, be placed) be bound to erect in so far as not already done substantial bounding and division walls around the piece of ground, the wall in the front and those extending from the front wall to the front of the buildings shall be dwarf coped walls 3' in height and surmounted with iron railings, the remaining walls including especially the wall separating the ground from the Mansion House Park of Tayfield shall be good rubble walls, the last mentioned wall to be 15" thick surmounted with a neat coping and not less that 6 nor more than 7 feet high; James Brown and his foresaids shall bear the cost of forming and keeping in proper order Kilnburn Row or Place to the extent of half of its width ... and other feuars in proportion to their frontage ... to form and maintain Kilnburn Lane in its whole extent from the ground feued to the Congregational Church to its western entry from the public road near to the house presently occupied by James Petrie coal merchant ... walls to bound Kilnburn Lane on both sides to be good rubble walls 15" thick and 6' high; Kilnburn Lane to be 20' wide instead of 15' width as originally proposed and is to be completed within 2 years ... to form a gravelled or other good and sufficient footpath 5' wide with stone kerb and surface water channel running along the whole length of the frontage of Kilnburn Row or Place ... the well or water spring in the said field which presently supplies Newport Inn with water shall be reserved to John Berry together with access when necessary to the said spring and power to lead a pipe therefrom underneath Kilnburn Row or Place and or Kilnburn Lane in such direction as John Berry shall require; James Brown and other feuars on the field, as soon as the whole lots shall be disposed of or sooner if John Berry thinks proper, shall join to provide a large common sewer through the said Park and down to the River Tay in such manner as John Berry shall desire, said common drain or sewer to be taken undeneath and to the east side of the Turnpike Road to Cupar ... also sufficient drains from each house to connect to the common drain. Also John Berry reserves the power to lead or connect a main drain or sewer from other lands belonging to him into said common drain; power to lay other drains or gas or water pipes underneath the roads and lanes in this feu. Entry, notwithstanding the date of this document, to be Martinmas 1872.
